I, Cathy Lewis, the breeder/owner of the said puppy (described below), hereafter "Seller", do enter into an agreement with the "Buyer" listed below, for the purpose of transferring ownership of the said puppy. The said puppy is a purebred Miniature Australian Shepherd. The puppy is described below and is to be registered with the America‘s Pet Registry, Inc.. The registration papers will include as part of the puppy's name, the registered "Kicks & Giggles" kennel name.

The Seller will transfer ownership of the said puppy for the agreed amount listed below, to be paid in full plus any shipping costs, before shipping said puppy, unless stated otherwise.

The Seller guarantees that the said puppy is in good health at the time of this agreement and of the shipping/delivery. The Buyer agrees to have the puppy examined by a veterinarian within (4) days of receiving said puppy. If the puppy is determined to be in poor health, the Buyer can elect to keep the puppy, assuming all costs for its care, or may return the puppy for a replacement puppy of the next upcoming litter upon the Seller's receipt of the veterinarians statement regarding the puppy's health, and stating the puppy is able to be shipped. Return of said puppy will be at the Buyer's expense.

If the puppy is bought for Breeding and/or Show the Buyer agrees that the puppy will be examined for eye defects and has been cleared, and be x-rayed and cleared of hip dysphasia. The pup will not be used for breeding until the age of two and upon receiving a Championship in conformation. If the puppy is determined to have eye defects, dysphasia, communicable diseases and/or hereditary defects of faults, it shall not be used for breeding and shall be spayed/neutered. If the Buyer keeps the said puppy, the agreement for future pay back puppies is void.

If, at sometime in the future, the Buyer is unable to keep the puppy he/she will contact the Seller before taking any action, so that the Seller can make arrangements to receive the puppy back. Up to the age of six months, Seller will give Buyer 50% of money collected when sold, if puppy can be resold, at the Seller's discretion. Under no condition will this puppy be put into a shelter, pound, or rescue.

The Buyer certifies by signing this contract, that the puppy will live with the Buyer, be confined by a fenced yard (or supervised), will have adequate exercise, nutritious food, and necessary health care, including yearly vaccinations. If purchased as a pet, Buyer has until the pup's age of six months to have it spayed/neutered. Seller must receive a copy of spay/neuter certificate before Buyer will receive registration papers.

The Seller will supply the Buyer upon receiving said puppy a four generation pedigree and a health record.

The Buyer agrees to furnish the Seller, approximately on puppy's first birthday, a color photo of said puppy for the Seller's records.

The Buyer certifies, by signing this contract, that he/she is not acting as an agent in this purchase; that the Buyer will not resell or give this puppy to any individual, pet store, guard dog business, puppy mill, or a medical research facility.

This contract is signed by both the Seller and the Buyer for the well being of the said puppy. If any part of this contract is breached by the Buyer, the Seller can and will repossess the puppy.
